Key Performance Indicators (KPIs)
- Time to Hire: Measures the average time taken to fill a position, from job posting to candidate acceptance.
- Cost per Hire: Calculates the total cost involved in hiring a candidate, including advertising, recruitment agency fees, and onboarding costs.
- Quality of Hire: Assesses the performance and retention rates of new hires, ensuring they meet or exceed client expectations.
- Client Satisfaction: Evaluates client satisfaction through surveys and feedback, ensuring our services consistently meet their needs and expectations.
Client Responsibilities
- Accurate Information: Require the client to provide accurate job descriptions and relevant information.
- Timely Communication: Emphasize the importance of timely feedback and communication from the client.
- Information in Writing: If any profile is duplicated by other sources or interviewed recently within 6 months, inform us in writing immediately.
Confidentiality
- Client Information: Business strategies, job descriptions, salary ranges etc.
- Candidate Information: Resumes, contact details, and work history etc.
- Agency Information: Internal processes, sourcing strategies, candidate’s information, payment terms etc.
All parties must protect and not disclose confidential information without consent, use it only for intended purposes, and return or destroy it upon request.
Non-Solicitation Clause
The client agrees not to directly solicit or hire the recruitment agency’s employees or candidates without the agency’s prior written consent. This clause remains in effect for 12 months following the last communication regarding the specific candidate or employee.
Liability and Indemnity
Limitations of Liability
- The recruitment agency's liability is limited to the fees paid by the client for the services rendered.
- The agency is not liable for any direct or indirect, incidental, or consequential damages arising from the recruitment process.
Indemnity
- The client agrees to protect and compensate the recruitment agency for any claims, damages, or expenses resulting from the client's use of the agency’s services.
Dispute Resolution & Governing Law
Governing Law
- This agreement shall be governed by and construed in accordance with the laws of Agra,UP,India.
Dispute Resolution Mechanism
- In the event of a dispute, the parties agree to first attempt to resolve the issue through mediation.
- If mediation fails, the dispute shall be settled through binding arbitration conducted in Agra,UP,India as per the rules of the Indian Constitution.
